Limited Warranty Coverage
The Limited Warranty coverage period begins on the date of shipment and continues for one (1) year. All products are shipped via FOB ORIGIN. The Purchaser/Buyer shall have thirty (30) days from the shipment date to inform A & J of any product defects discovered during their inspection process. The Limited Warranty Claims must be made in writing and delivered to A & J within the warranty period.
This Limited Warranty is extended only to the original purchaser who places the purchase order and who contracts directly with A & J Manufacturing Company. This Limited Warranty does not extend to any person or entity to which the physical goods may be sold or transferred to by the original purchaser.
Corrective Action Remedy
During the Limited Warranty period, A & J Manufacturing Company will either rework or replace (at A & J’s discretion), and at no charge to original purchaser, products or components that prove defective because of defective material or workmanship. All decisions with respect to whether to replace defective parts or the entire assembly shall be solely within the discretion of A & J, and A & J may also choose to provide a refund to the original purchaser rather than replace the product.
In the event the original purchaser believes a product is defective, original purchaser must contact A & J, in writing, with the warranty period and describe the alleged defect. Upon receipt of notification, A & J will investigate and evaluate the alleged defect, determine whether the alleged defect is within the warranty coverage, and determine whether return of the product is required. Any return of product without the express written authorization of A & J shall be at the sole expense of original purchaser. Any product returned to A & J must have a Return Material Authorization (RMA) number. Contact the Quality Department for an RMA number. Unless otherwise agreed to by A & J, in writing, shipping cost for all product returned to A & J and return shipping cost to purchaser will be at the sole expense of original purchaser.
Limited Warranty Period
The Limited Warranty coverage period begins on the date of shipment (A & J ships FOB Origin) and continues for One (1) year. Purchaser shall have thirty (30) days after shipment date to advise A & J of any product defect discovered during their inspection process. This Limited Warranty will apply only to claims made, in writing, and delivered to A & J within the warranty period.
Limited Warranty Exclusions
This Limited Warranty covers only defects in material supplied by A & J and specifically excludes any product problem or failure caused by:
Conditions, malfunctions or damage not resulting from defects in material and workmanship, including but not limited to Acts of God, natural disasters, Force Majeure, theft, vandalism, criminal acts, riots, accident, negligence, rough handling, chemical exposure, unauthorized use or unauthorized repairs or attempted repairs, damage caused by equipment installation, or shipping damage. Any modifications or changes made to A & J’s product by the Purchaser will immediately void any and all written or implied warranties and relieve A & J of any and all obligations and/or responsibilities under this warranty.
Limited Warranty Liability
A & J Manufacturing Company’s liability for products determined to be defective due to A & J supplied material or workmanship shall be limited to repair, replacement or refund, at A & J’s discretion, and in no event shall A & J be liable for any incidental, special, punitive or consequential damages or losses or any kind arising under or in connection with the product or services, regardless of legal theory, including any such damages or losses resulting from business interruption or lost profits.
Limited Warranty for Replaced Products
If A & J Manufacturing Company replaces a defective product with a new or reworked product, this Limited Warranty will apply to that material and workmanship as if the product were a new purchase.
Special Circumstances
If circumstances warrant, A & J may opt, at its sole discretion, to perform any evaluation, rework, or replacement of defective product at the customer’s facilities.
Exclusion of All Other Warranties
This Limited Warranty is in lieu of all other warranties, express or implied, and supersedes any prior discussion, representations or promises. This Limited Warranty may not be altered or amended except in writing.
