A&J MANUFACTURING COMPANY PRODUCT WARRANTY
A&J Manufacturing Company warrants to the original purchaser that all of its products are thoroughly inspected before shipment and guaranteed against defects in material and workmanship to the extent expressly provided in this policy for a period of 12 months from the date of the original shipment. No claims under this warranty will be valid unless Buyer provides a written notice to A&J within a reasonable time of discovery of any defect within the warranty period. A&J’s responsibility will become void should the product be subject to abuse, misuse, or improper installation.
THE FORGOING WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER EXPRESS AND IMPLIED WARRANTIES WHATSOEVER , INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND WARRANTIES OF FITNESS OR SUITABILITY FOR ANY PARTICULAR PURPOSE.
A&J Manufacturing Company’s extent of liability shall be limited at its option, to the purchase price of the product or replacement or repair of the product once we have determined that said product is impaired for the use in which it was intended due to a defect in material or workmanship. No such repair or replacement will extend the Warranty Period.
In the event of a warranty claim, Buyer is to return defective goods to A&J Manufacturing Company in accordance with A&J Manufacturing Company’s Return Policy. Buyer must contact A&J Manufacturing Company to arrange return shipment to A&J Manufacturing Company, with freight prepaid by Buyer.
RETURN AND REPAIR POLICY
A&J Manufacturing Company products that: (i) are made to order, (ii) have been modified by Buyer, (iii) have special finishes, or (iv) are determined by A&J Manufacturing Company to constitute “custom” products that cannot be returned to stock or resold to other Buyers, will not be accepted for return by A&J Manufacturing Company.
All returns must have prior approval by A&J Manufacturing Company and are subject to a 25% restocking fee for standard Equipment Racks and standard Installation Kits within 60 days of purchase. To return standard Equipment Racks or standard Installation Kits, an RMA number must be requested in writing. The original P.O. must be submitted when requesting the RMA.
Returned equipment will be inspected and evaluated by the Quality Assurance Department for condition. If the equipment is found to be in new condition with no damage, the equipment will be returned to stock and a credit invoice will be issued minus the restocking charge. If the equipment is found to be damaged, a credit invoice will be issued minus the repair cost and restocking charges.
LIMITATION OF LIABILITY
A&J MANUFACTURING COMPANY WILL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LOST PROFITS OR LABOR COSTS, ARISING FROM THE SALE, USE OR INSTALLATION OF THE PRODUCTS, FROM THE PRODUCTS BEING INCORPORATED INTO OR BECOMING A COMPONENT OF ANOTHER PRODUCT, FROM ANY BREACH OF THIS AGREEMENT OR FROM ANY OTHER CAUSE WHATSOEVER, WHETHER BASED ON WARRANTY (EXPRESSED OR IMPLIED) OR OTHERWISE BASED ON CONTRACT, OR ON TORT OR OTHER THEORY OF LIABILITY, AND REGARDLESS OF ANY ADVICE OR REPRESENTATIONS THAT MAY HAVE BEEN RENEDERED BY A&J MANUFACTURING COMPANY CONCERNING THE SALE, USE OR INSTALLATION OF THE PRODUCTS.
